By using CampusBoard, you agree to be bound by the following terms and conditions ("Terms of Use"). This agreement is personal to you; it cannot be assigned or transferred. If any provision of this agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect.
By accessing and/or using the CampusBoard platform, you signify your agreement to:
CampusBoard ("CampusBoard," "the Company," "we," "us," "our") is a cloud-based Learning Management System (LMS) and Enterprise Resource Planning (ERP) platform licensed to independent schools, colleges and universities ("Partner Institutions") for use by their students, faculty, administrators and staff (collectively, "Users").
The term "Platform" includes all features made available through CampusBoard's web and mobile applications, including but not limited to course content, learning materials, assignments, assessments, attendance tracking, grades and academic records, timetables, fee and payment tracking, notices and circulars, messaging between students and faculty, discussion boards, and integrations with a Partner Institution's existing Student Information System (SIS), such as PowerSchool or similar systems.
CampusBoard is a technology provider. Each Partner Institution is independently responsible for its own academic policies, admissions, curriculum, fee structures, and the accuracy of information it or its students and staff post on the Platform. CampusBoard does not review, verify or endorse content, grades, notices or other information provided by a Partner Institution or its Users.
CampusBoard may link to or integrate with third-party services (for example, a Partner Institution's SIS, payment gateways, or video-conferencing tools) that are not owned by, affiliated with, or controlled by CampusBoard. CampusBoard has no control over, and assumes no responsibility for, the content, privacy policies or practices of such third-party services. By using the Platform, you release CampusBoard from any liability arising from your use of any third-party website or service linked from or integrated with CampusBoard.
Access to CampusBoard is provisioned by your Partner Institution to its students, faculty and staff. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify CampusBoard and your Partner Institution immediately of any unauthorized use of your account or any other breach of security.
You agree that the information you provide during registration and throughout your use of the Platform is accurate and that you will keep it up to date.
Partner Institutions access CampusBoard under a subscription or licensing arrangement, the terms of which (including fees) are set out in the applicable order form or agreement between CampusBoard and the Partner Institution. Where a Partner Institution uses CampusBoard's fee-collection features to receive tuition or other fees from students, CampusBoard acts solely as a technology facilitator; the fee amounts, due dates and refund entitlements for such payments are set by the Partner Institution, not by CampusBoard. You agree to use CampusBoard in accordance with all applicable laws and only for its intended academic and administrative purposes. You agree not to use the Platform for commercial solicitation or activity unrelated to your Partner Institution. This includes your interactions with other users through messaging, discussion boards, or any other communication feature on the Platform.
Prohibited conduct includes:
CampusBoard does not actively screen or monitor all content posted by users, but reserves the right to remove content and restrict or terminate access for violations of these rules, upon becoming aware of them, and may refer conduct issues to the relevant Partner Institution for action.
CampusBoard includes communication features (such as messaging, notices and discussion boards) intended for communication between students, faculty and administrators of the same Partner Institution. CampusBoard does not routinely monitor these communications, but reserves the right to take action against any user who defames or harasses another user through the Platform. By using CampusBoard, you agree to receive academic and administrative communications, including SMS, app notifications and emails, related to your enrollment and coursework, sent by or on behalf of your Partner Institution.
CampusBoard does not warrant that the Platform will operate in an uninterrupted or error-free manner, or that it is free of viruses or other harmful components. Use of CampusBoard is at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMPUSBOARD WILL NOT BE LIABLE TO YOU FOR ANY LOSS OR DAMAGES, ACTUAL OR CONSEQUENTIAL, ARISING OUT OF OR RELATING TO THESE TERMS OF USE, YOUR USE OF OR INABILITY TO USE THE PLATFORM, OR YOUR RELIANCE ON INFORMATION OBTAINED THROUGH THE PLATFORM, INCLUDING INFORMATION OR DECISIONS ORIGINATING FROM YOUR PARTNER INSTITUTION. THIS INCLUDES, WITHOUT LIMITATION, ANY DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE, SPECIAL OR INCIDENTAL DAMAGES, WHETHER FORESEEABLE OR NOT, INCLUDING LOSS OF DATA OR INTERRUPTION IN AVAILABILITY OF THE PLATFORM, EXCEPT TO THE EXTENT THAT APPLICABLE LAW REQUIRES OTHERWISE.
These Terms of Use, and any dispute or claim arising out of or in connection with them or the Platform (including non-contractual disputes), shall be governed by and construed in accordance with the laws of India.
You agree that any dispute arising out of or relating to these Terms of Use or the Platform shall be subject to the exclusive jurisdiction of the competent courts at Gurugram, India, and you waive any objection to the exercise of jurisdiction by, or venue in, such courts.
CampusBoard reserves the right to update these Terms of Use from time to time. We will notify you of material changes by updating the "Last Updated" date on this page, sending an electronic communication, or posting a notice within the Platform. Your continued use of CampusBoard after such changes take effect constitutes acceptance of the revised Terms of Use.
Your access to CampusBoard is tied to your enrollment or employment status with your Partner Institution; account termination requests should generally be directed to your Partner Institution, which will notify CampusBoard.
CampusBoard may suspend or terminate your account or access to the Platform at any time, without notice, for conduct that CampusBoard believes violates these Terms of Use or is harmful to other users, to CampusBoard, or to a Partner Institution.
The CampusBoard name, logo and all associated graphics are trademarks of CampusBoard or its affiliates. You must not use, reproduce or redistribute these marks without prior written permission. All other trademarks appearing on the Platform, including those of Partner Institutions, belong to their respective owners.
You agree to defend, indemnify and hold harmless CampusBoard, its officers, employees and agents from any claims, losses or damages, including legal fees, resulting from your violation of these Terms of Use or your use of the Platform, and to cooperate fully in CampusBoard's defence against any such claims.
By posting content on CampusBoard, you grant CampusBoard a non-exclusive, royalty-free, perpetual licence to use, reproduce and distribute such content solely for operating and improving the Platform on behalf of your Partner Institution.
CampusBoard respects the intellectual property rights of others and will act on legitimate takedown requests under applicable Indian law, including the Copyright Act, 1957 and the Information Technology Act, 2000. If you believe your copyright has been infringed on the Platform, please write to us with: your name and contact details; identification of the infringing material and its location on the Platform; a statement of good-faith belief that the use is unauthorized; and a statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
These Terms of Use, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and CampusBoard with respect to the Platform, and supersede all prior understandings, whether written or oral.
